With UK currently in Lockdown, we are aware that many of our clients will have taken the difficult decisions to reduce staffing levels or the closure of their buildings, to assist in reducing the spread of Covid-19.

However, please be aware that such actions can increase the chances of Legionella surviving in water systems as a direct result of low turnover of water within systems that are not being used as frequently, or as a result of existing control measures that are in place not being implemented at times of closure or low occupancy.

We have received guidance from the Legionella Control Association (LCA) regarding what the expectation is for the management of water systems during this period of COVID-19 precautions.

The Health and Safety at Work Act still applies and Duty Holders must still take reasonable practical steps to control the risk from Legionella throughout this period of time. Duty Holders implicated in an outbreak of Legionnaires disease, resulting from actions taken for COVID-19 precautions are not likely to have any exemption from prosecution.”

Each Duty Holder must make their own determination for each circumstance, but the following principles should be considered when making decisions on what to do to control Legionella during the COVID-19 outbreak.

Closing down or mothballing buildings?

Should the difficult decision have been made to shut down or mothball buildings, due to a reduction in workforce or the temporarily shutdown of the business during the COVID-19 outbreak, we advise the following control measures are implemented:

  • Where possible, it is advised that all stored water is drained down to reduce the potential of stagnation of water within water systems.
  • If this cannot be carried out, then it is recommended to reduce the volume of stored water to ensure that there is a maximum of 24 hours’ worth of stored water.
  • Revise your sites current infrequently used outlet list and amend to include outlets in areas that have been mothballed.
  • Increase the flushing of infrequency used outlets, recording this action in the log book.
  • Ensure all cold water is stored and delivered from outlets at less than 20°C.
  • Ensure all stored hot water above a capacity of 15 litres is stored at a minimum temperature of 60°C.
  • Ensure all stored hot water below a capacity of 15 litres is stored between 50°C – 60°C.  
  • Any hose pipes, water systems and appliances/machinery without back flow protection as per water regulations, should be disconnected when not in use.

Recommissioning of water systems

When the spread of COVID-19 can be controlled and normal life as we know it can be resumed, and businesses start to re-open. It is essential that water systems are not simply put back in to use. It is sensible to put together a recommissioning plan for each water system within the building, to provide reassurance to people returning to work that the water systems are safe for normal use. To ensure the safety of employees throughout the business, the following control measures are recommended:

  • A chemical disinfection of all Cold water storage tanks, storage vessels & header tanks, where possible including their associated water systems.
  • A thermal disinfection/ pasteurisation or all hot water heaters, where possible including their associated water systems.
  • Ensure all outlets and associated systems are flushed thoroughly.
  • Expansion vessel are purged and drained.
  • Where possible samples of the water should be taken ensure all control measures implemented were successful in reducing the proliferation of bacteria.
  • Shower heads, hoses & spray heads should be dismantled, cleaned and chlorinated.
  • Limescale should be removed from outlets.
  • Check water softening equipment is fit for use.

There is potential for multiple outbreaks of Legionnaires’ disease following the COVID-19 outbreak if actions taken now are not carefully considered and additional controls put in place for when normal life returns. How do you know if your Legionella Risk Assessment is out of date?

If you have made any changes to your water system, such as adding or removing a tap, shower head or other water outlet, you must have a new risk assessment.

Water systems must be compliant with L8, the Approved Code of Practice and guidance on Legionnaires’ disease, issued by the Health & Safety Executive (HSE).

Leisure centre reopens after Legionella bacteria decontamination

A leisure centre that was forced to close to allow an urgent Legionella bacteria decontamination programme to take place has reopened.

The Lifestyles centre, in Walton-on-the-Naze, in Essex, was shut in December after it was reported that a customer had contracted Legionnaire’s disease.

The centre’s operator, Tendring Council, immediately brought in Legionella consultants to carry out comprehensive Legionella testing of the water system at Lifestyles.

Three months later, the centre, which has a swimming pool and gym, has reopened after a series of modifications were made to the water system.

Legionella bacteria – major risks

The case demonstrates how Legionella in leisure centres can cause health hazards, major inconvenience to customers, significant loss of income and incurred costs, and reputational risks.

Once the Legionella problem was identified, Tendring council acted swiftly to ensure its staff and the public were safe.

In a statement published on its website, Tendring Council said:

Significant work has been carried out at the site on The Esplanade, which is owned by Tendring District Council (TDC). The modifications were recently completed and water tests carried out to ensure it was clear of the bacteria.

Those tests have come back negative and customers are now able to return to using the gym and pool facilities.

Lynda McWilliams, TDC’s Cabinet Member for Leisure and Partnerships, said it was important for the Council to receive the all-clear before reopening.

“The modifications have taken longer than we first anticipated but it is very difficult when you start out to estimate the exact period that the programme of works would take,” she said.

Tendring Council should be applauded for its swift action. However, as the statement makes clear, once Legionella contamination occurs, it can be difficult to recover the situation quickly, and with certainty in relation to timescales, which can only add to financial and reputational costs.

Legionella risk assessment needed by GP practices

Carrying out a Legionella risk assessment is an essential requirement for GP practices to demonstrate that they are fully compliant with health and safety regulations and legislation.

This point as been made clear with the case of the Hawthorn Drive GP practice in Ipswich, which has been rated ‘inadequate’ by the Care Quality Commission, the social and health care watchdog.

One of the findings detailed in the CQC’s inspection report was that the practice, which cares for more than 8,000 NHS patients, had not undertaken a Legionella risk assessment.

The Legionella bacteria can cause Legionnaire’s disease, a potentially fatal form of pneumonia.

Legionella risk to GP patients

There is a greater risk of elderly people and people with weakened immune systems contracting Legionnaire’s disease, so GP surgeries need to be sure they are Legionella compliant.

The report, which has been published following a planned inspection in November 2016, acknowledged that practice staff have pledged to make improvements, including to systems for Legionella control.

Carrying out a Legionella risk assessment is the first stage in a four-stage process to put in place an effective regime for the control of the Legionella bacteria.

Without carrying out a risk assessment, companies, organisations, and public bodies, such as GP surgeries, cannot demonstrate they are meeting their legal obligations in relation to the Legionella bacteria.

Once the Legionella risk assessment is completed, remedial work can be carried out, if it is needed, Legionella monitoring can be put in place, which includes an appropriate water system testing regime, and Legionella awareness and technical training can be given to staff.
